The Basque Government passes the Institutional Advertising and Communications Law of the Basque Country

The government spokesperson describes the appeal presented by the Government of La Rioja against the Basque Economic Agreement as "electioneering"

This morning, the Cabinet passed the Institutional Advertising and Communications of the Basque Country White Paper. This law establishes "clearly" the framework in which the institutional advertising and communications campaigns of public administrations must be developed, as the government spokesperson, Idoia Mendia, explained. Moreover, the spokesperson criticised the appeal presented by the Government of La Rioja against the Basque Economic Agreement as "electioneering". Mendia added that, "Not only does the economic agreement form part of the Spanish Constitution but of the EU as well, and it is clear that fiscal regulations are laws and can be appealed against only by certain agents before the Constitutional Court".

This morning, the Cabinet passed the Advertising and Communications of the Basque Country White Paper. This law establishes "clearly" the framework in which the institutional advertising and communications campaigns of public administrations must be developed, as the government spokesperson, Idoia Mendia, explained. The government spokesperson pointed out that the law demands that these campaigns "comply with the principle of providing the public with true and objective information, set out and oriented towards the general dissemination of messages providing information on the services and activities of the institutions".

Following the weekly cabinet meeting, the government spokesperson, Idoia Mendia, gave an account of the agreements reached at the meeting at the customary press conference.

As Mendia explained, the law was promoted by the Department of Justice and Public Administration and during its development the opinions of the advertising agency associations of Bizkaia and Gipuzkoa, as well as the Chamber of Commerce and Industry of Alava, were consulted for the first time. "The legal text comes in response to an already existing demand in the Basque Country, as the precursor to this government White Paper was Decree 151/April 18, 1989, which created the Interdepartmental Advertising Commission, 21 years ago," she recalled.

Among other things, this law "establishes the prohibition to carry out institutional campaigns of "self-glorification", the aim of which is to highlight the successes of a government or administration". The White Paper states, furthermore, that any advertising that may be deemed as failing to comply with the stipulations contained in the law may be stopped and rectified.

Concerning the appeal presented by the Government of La Rioja against the Basque economic agreement, Mendia pointed out that the Basque Government "regrets" the decision of the aforementioned government to present its appeal, for which "there is no motive". Mendia added that, "Not only does the economic agreement form part of the Spanish Constitution but of the EU as well, and it is clear that fiscal regulations are laws and can be appealed against only by certain agents before the Constitutional Court".
